Terms of Service
These Terms of Service (the "Terms") govern your access to and use of the WasteGrid website, waitlist, and any restricted-access platform services (together, the "Platform"), operated by WasteGrid Ltd, a company registered in England and Wales with company number 17167912 and registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ ("WasteGrid", "we", "us", or "our").
By accessing, submitting information to, or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
The Platform is being developed as a specialist recruitment and industry infrastructure service for the UK waste, recycling, and environmental services sector. At present, public access is limited primarily to informational pages, selected enquiry and waitlist forms, and restricted or administrative tools. Broader candidate, employer, and partner functionality may be introduced later and may be subject to additional service-specific terms.
Definitions
In these Terms, the following definitions apply:
Eligibility and Account Registration
Candidate Eligibility
Candidates must be at least 18 years of age and legally entitled to work in the United Kingdom. By registering, Candidates confirm that they meet these requirements.
Employer and Third Party Recruiter Eligibility
Employers must be legitimate businesses registered or operating lawfully in the United Kingdom. Third Party Recruiters must hold any relevant licences or registrations required by UK law. WasteGrid reserves the right to verify Employers and Third Party Recruiters through Companies House, Environment Agency records, trade body membership, and other reasonable means before granting Account access.
Account Creation
Public visitors may access certain informational pages and selected submission forms without creating an Account. Account access to restricted areas of the Platform may be limited to approved, invited, or administrative users. Self-service registration for Candidates, Employers, or Third Party Recruiters may be unavailable, restricted, or subject to additional checks while the Platform is in preview, maintenance, or staged release.
Account Accuracy
You agree to provide accurate, current, and complete information when registering and to keep your Account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account.
Candidate Information and Verification
Self-Declaration
Candidates are responsible for the accuracy of all information they provide about themselves, including but not limited to work history, qualifications, licences held (such as HGV licences, WAMITAB qualifications, CPCS cards, and NEBOSH certifications), site experience, and contact details.
No Verification by WasteGrid
WasteGrid does not independently verify Candidate information. Employers and Third Party Recruiters are responsible for conducting their own due diligence before making any hiring decision, including but not limited to verifying licences, right to work in the UK, references, and any other relevant qualifications.
Misrepresentation
Candidates who knowingly provide false or misleading information may have their Account suspended or permanently removed at WasteGrid's sole discretion. Misrepresentation of safety-critical qualifications (such as driving licences or plant operator certificates) is taken particularly seriously and may be reported to the relevant authorities.
Employer Conduct and Job Adverts
Content of Job Adverts
Employers and Third Party Recruiters must ensure that all job adverts posted on the Platform are accurate, lawful, and genuine. Adverts must clearly state the nature of the role, the location, any required qualifications, and the basis of engagement (employed, self-employed, fixed-term, etc.).
Equality Act 2010 Compliance
Job adverts must comply with the Equality Act 2010. WasteGrid reserves the right to reject or remove any advert that appears to discriminate on the basis of age, sex, race, disability, religion or belief, sexual orientation, gender reassignment, pregnancy or maternity, marriage or civil partnership, or any other protected characteristic.
Where a genuine occupational requirement applies under Schedule 9 of the Equality Act 2010, Employers must be able to demonstrate the basis for the requirement on request.
Prohibited Content
Employers and Third Party Recruiters must not post job adverts that:
- Advertise roles that do not exist, are speculative, or are designed primarily to harvest Candidate data.
- Advertise roles outside the UK waste, recycling, environmental services, or related sectors without prior written consent from WasteGrid.
- Contain misleading pay information, hidden deductions, or unlawful employment terms.
- Require payment from Candidates as a condition of employment or engagement.
- Breach any UK law, including employment, health and safety, immigration, or data protection law.
Employer Verification
Where employer-facing services are made available, WasteGrid may verify Employers during onboarding or account setup. This may include checks against Companies House, the Environment Agency's public registers, relevant trade bodies (such as ESA, CIWM, or ADBA), and other sources. WasteGrid reserves the right to refuse, restrict, or suspend access where verification cannot be completed or where concerns are identified.
Fees, Payments, and Billing
Current Position
At the date of these Terms, WasteGrid does not offer public self-service subscriptions, premium candidate plans, or publicly published employer plan pricing through the live Platform unless expressly stated elsewhere on the site or agreed separately in writing.
Restricted Access Services
WasteGrid may provide restricted, pilot, or administrative services to selected users without making those services generally available to the public. Access to those services may be governed by invitation terms, onboarding terms, or separate written agreements.
Future Paid Services
If WasteGrid introduces Paid Services in future, the applicable pricing, billing cycle, renewal terms, and cancellation rights will be shown clearly at the point of purchase or set out in a separate agreement before any charge becomes due.
Promotional Features
WasteGrid may introduce optional promotional or visibility features in future. If such features are introduced, the eligibility rules, pricing model, and any consumption or expiry rules will be described on the Platform or in the relevant commercial terms.
Payment Processing
Where Paid Services are enabled, payments may be processed through a third-party payment provider designated by WasteGrid from time to time. WasteGrid does not intend to store full payment card details on its own systems unless expressly stated otherwise.
Refunds
Where charges apply, refund rights will be governed by the terms presented at the point of purchase, any applicable separate agreement, and your statutory rights. WasteGrid may suspend or terminate access for breach of these Terms without refund where permitted by law and the applicable commercial terms.
VAT
Any fees quoted by WasteGrid will state whether VAT is included or excluded. Where VAT is chargeable, it will be added or shown in accordance with applicable law.
Platform Use and Communications
Communications and Submissions
WasteGrid may provide contact forms, waitlist forms, upload tools, email channels, or other communication methods from time to time. You must ensure that any information you submit is accurate, lawful, and does not infringe any third-party rights. WasteGrid may restrict, monitor, or disable communication features to protect the Platform, support staged rollout, or comply with legal obligations.
Recommendations and Automated Features
Where the Platform makes available matching, recommendation, classification, or filtering tools, those outputs are provided for guidance only and do not constitute an endorsement, guarantee, or legal determination by WasteGrid.
Acceptable Use
All users agree not to:
- Create fake or duplicate Accounts.
- Impersonate another person or organisation.
- Scrape, harvest, or otherwise extract data from the Platform by automated means.
- Use the Platform to send unsolicited marketing, spam, or harmful content.
- Attempt to gain unauthorised access to the Platform, other users' Accounts, or WasteGrid's systems.
- Upload viruses, malware, or any other harmful code.
- Use the Platform for any unlawful purpose.
Account Suspension and Termination
WasteGrid reserves the right to suspend or terminate any Account at its sole discretion where a user has breached these Terms, where verification cannot be completed, or where WasteGrid reasonably believes that continued use poses a risk to other users or to the integrity of the Platform. WasteGrid will generally give reasonable notice before terminating an Account, except where immediate action is necessary.
Upon termination of an Account by WasteGrid, the user's Content may be removed from the Platform at WasteGrid's discretion. Personal data will be handled in accordance with the Privacy Policy and the user's rights under the UK GDPR, including the right to request deletion under section 11.
Intellectual Property
WasteGrid's IP
The Platform, including its design, branding, software, databases, and all associated intellectual property rights, is and remains the exclusive property of WasteGrid Ltd. Nothing in these Terms transfers any ownership rights in the Platform to any user.
User Content
By submitting Content to the Platform (including profiles, job adverts, and messages), you grant WasteGrid a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and distribute that Content for the purpose of operating the Platform. You retain ownership of your Content.
Feedback
Any feedback, suggestions, or ideas you provide to WasteGrid about the Platform may be used by WasteGrid without obligation or compensation to you.
Data Protection and Privacy
WasteGrid processes personal data in accordance with the UK General Data Protection Regulation and the Data Protection Act 2018. Full details of how we collect, use, store, and protect personal data are set out in our Privacy Policy, which is available at wastegrid.co.uk/privacy-policy.
By using the Platform, you acknowledge that you have read and understood the Privacy Policy.
WasteGrid is registered with the Information Commissioner's Office (ICO) as a data controller.
WasteGrid uses cookies and similar tracking technologies on the Platform. Full details of the cookies we use and how to manage your preferences are set out in our Cookie Policy, available at wastegrid.co.uk/cookie-policy.
Limitation of Liability
Platform Role
WasteGrid provides a matching platform. It is not a party to any employment contract, engagement, or placement between Candidates and Employers or Third Party Recruiters. WasteGrid is not responsible for the conduct of any user, the accuracy of any Content, or the outcome of any hiring or engagement made through the Platform.
No Warranty
The Platform is provided on an "as is" and "as available" basis. WasteGrid does not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components. WasteGrid makes no warranty regarding the quality, reliability, or suitability of any Candidate, Employer, Third Party Recruiter, or Content.
Limits on Liability
To the maximum extent permitted by law, WasteGrid's total aggregate liability to any user arising out of or in connection with these Terms or the use of the Platform, whether in contract, tort (including negligence), or otherwise, shall not exceed the total amount paid by that user to WasteGrid in the twelve (12) months preceding the event giving rise to the claim.
WasteGrid shall not be liable for any indirect, special, consequential, or punitive damages, or for any loss of profit, loss of business, loss of goodwill, or loss of data.
Exclusions
Nothing in these Terms excludes or limits WasteGrid's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited by English law.
Indemnity
You agree to indemnify and hold WasteGrid harmless from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your misuse of the Platform, or your infringement of any third party's rights.
Data Export and Account Deletion
Users may request access to, export of, or deletion of their personal data in accordance with the UK GDPR. Where self-service account controls are available, they may be used for these requests. Otherwise, requests should be sent to privacy@wastegrid.co.uk.
WasteGrid will handle valid requests within applicable statutory timeframes, except where retention is required by law or for the establishment, exercise, or defence of legal claims.
Dispute Resolution
Informal Resolution
In the event of any dispute arising out of or in connection with these Terms, the parties agree to first attempt to resolve the dispute informally by contacting WasteGrid's support team at hello@wastegrid.co.uk.
Written Complaint
If informal resolution is unsuccessful, the aggrieved party may submit a written complaint to WasteGrid. WasteGrid will respond in writing within 30 days of receipt.
Mediation
If the dispute remains unresolved, the parties agree to attempt mediation through the Centre for Effective Dispute Resolution (CEDR) before commencing court proceedings, save for applications for urgent injunctive relief.
Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
Changes to These Terms
WasteGrid may update these Terms from time to time to reflect changes to the Platform, legal requirements, or business practices. Where changes are material, WasteGrid will give users at least 30 days' notice by email or through the Platform. Continued use of the Platform after the effective date of the revised Terms constitutes acceptance of the changes.
Force Majeure
WasteGrid shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond WasteGrid's reasonable control, including but not limited to acts of God, fire, flood, severe weather, power failures, internet or telecommunications outages, cyberattacks, acts of government, or failures of third party infrastructure providers.
Where such circumstances persist for a period of 30 days or more, WasteGrid will use reasonable endeavours to notify affected users and, where any Paid Service is subject to a separate commercial agreement, will deal with the impact on that service in accordance with the applicable commercial terms.
General
Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and WasteGrid regarding your use of the Platform and supersede any prior agreements.
Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
No Waiver
WasteGrid's failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
Assignment
You may not assign or transfer your rights or obligations under these Terms without WasteGrid's prior written consent. WasteGrid may assign or transfer its rights and obligations under these Terms without restriction.
Third Party Rights
A person who is not a party to these Terms has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.
